1. Definitions

a) ‘Bank’ shall mean the YES Bank Limited.

b) ‘Customer(s)’ shall mean the person(s) who hold a valid YES Bank Card.

c) 'Merchant Partner’ shall mean the merchant outlet, where Offers are being provided/availed.

d) ‘Offer(s)’ shall mean the dining and related offers as provided in the Website.

e) ‘Website’ shall mean the microsite available at the URL https://diningfiesta.yesbank.in/

f) ‘YES Bank Card’ shall mean debit card or credit card issued by the Bank, which holds valid (i.e. not restricted, cancelled or withdrawn) while availing the Offers.

2. These Offers will be available only for Bank’s Customers, holding valid Yes Bank Card.

3. Participation/availing of these Offers are voluntary and free, subject to these terms and conditions.

4. To avail the Offer, before billing the Customer shall inform the Merchant Partner about the intention to avail the Offer and shall present his/her Yes Bank Card.

5. The payment of the bill amount shall be made using YES Bank Card, to be eligible for the benefit/discount under the Offer.

6. The Offer benefits cannot be used or redeemed in combination with any other discounts or promotions or vouchers or 'Sunday Brunches' or 'Happy Hours' or any other such promotions.

7. These Offers are not valid on the blackout dates (24th Dec 25th Dec, 31st Dec, 14th Feb) and public holidays, unless otherwise specifically stated by the individual Merchant Partner. Customers are advised to contact the Merchant Partner directly, before visiting.

8. Bank merely facilitate these Offers, and it is in no way concerned or connected in respect of terms and conditions of the Merchant Partner.

9. Bank reserve the right, at its sole discretion to add/alter/modify/change/vary all or any of these terms and conditions, or to extend, withdraw or replace these Offers, either wholly or in part, without prior intimation/notice and without assigning any reason.

10. The Bank shall not be responsible or liable in any manner whatsoever for any deficiency or inadequacy in the services rendered by the Website and/or Merchants Partner, including their agents or representatives, and the Customer hereby acknowledges and agrees not to hold the Bank responsible or liable for, any losses, damages, costs, charges, expenses, claims, actions or demands suffered by the Customer (whether direct or indirect), in relation to accessing the Website and/or availing the benefits under the Offers.

11. The Bank holds out no warranty and makes no representation about the quality, delivery or otherwise of the goods and services offered by Merchant Partner. Any issue or dispute or claim arising out of or in relation to availing the benefits under these Offers must be resolved by the Customer directly with the Merchant Partner without any reference to the Bank.

12. Bank does not guarantee or warranty or make any representation about the usefulness, worthiness and/or character of the product/service and/or discount or benefit under the Offers.

13. This Offers has no monetary value, is not transferable, is not for sale or re-sale nor redeemable for cash.

14. Offers are valid on ‘A La Carte’ orders only.

15. Offers are not valid on group bookings (8 pax and above).

16. The discount under the Offer is valid only on the net billing amount (i.e. excluding taxes or any other charges).

17. Any applicable taxes must be paid by the card holder.

18. Offers will be valid only during the period specified in the Website.

19. These Offers doesn't guarantee any reservations or admissions at Merchant Partner’s outlet, Customers are advise to contact the Merchant Partner directly, before visiting.

20 The availability of the Offers shall be subject to the terms and conditions stipulated by the respective Merchant Partner, as applicable from time to time.

21. In case the Merchant Partner refuses to provide the Offer, in spite of adhering to all the applicable terms and conditions, please retain the original bill issued by the Merchant Partner and share the copy of the same with the Bank, within 72 hours of the incident.

22. The Website and the Bank shall not be liable for any indirect, incidental and consequential damages/losses or for any loss or damage arising due to force majeure event .

23. In the event of any misuse or abuse of these Offers by the customer, the Website and the Bank reserve the right to deny the Offers.

24. In case of any dispute with regard to the interpretation of any of the clause or term of these terms and condition, the opinion of the Bank shall be final and binding on all parties to the dispute.

25. Any dispute regarding these Offers will be subject to exclusive jurisdiction of courts in Mumbai, Maharashtra.
